Activist Judges

The re-"interpretation" of the Constitution. Very interesting article worth discussing.

First of all, the ruling is disgusting.

Second, the actual piece:
Amendment I

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

This does provide free exersise of religion and protests. However, it does not address vulgarity or obsenitys.

I personally think this is a states issue, but even states rights in this arena have been trampled recently, as in the texas sodomy case refered to in the article.

No, it is the courts job to uphold the laws implemented by the people represenatives. The United states is not a democracy, or mob rule. It is a constitutional republic, and the constitution is the highest law in the land, not what the people want at the moment.
